Terms of Service

Effective date: 1 August 2026
Provider: isekio, operated by Jarrah Lynch (ABN 34 580 154 022) (“isekio”, “we”, “us”).
Contact: info@isekio.com.au

By creating an account or using isekio, you agree to these Terms. If you don’t agree, don’t use the service.

1. What isekio is — and what it is not

isekio is a drafting tool for heritage, archaeology and contaminated-land reports. It pulls public register data and drafts report text in the relevant structure, showing the source behind each line.

isekio is not a provider of heritage, archaeological, environmental, planning, engineering, legal or other professional advice, and its output is not professional advice. You are the professional. Every draft must be reviewed, corrected, verified against its sources, and approved by you before use. You make every judgement (including significance grading and findings), you sign the report, and you retain full professional responsibility and liability for it. isekio does not review, endorse or take responsibility for any report you produce.

2. Eligibility and accounts

You must be a practising professional (or working under one) competent to prepare the reports you use isekio for, and at least 18. Keep your account credentials secure; you’re responsible for activity under your account. Provide accurate details and keep them current. Accounts and seats are per the plan you purchase.

3. Your content and your reports

You retain all ownership of the information you input (“Inputs”) and the reports you produce using isekio (“Outputs”). We claim no ownership of them. You grant us a limited licence to host, process and transmit your Inputs and Outputs solely to provide and support the service (including sending content to our AI provider to generate drafts — see the Privacy Policy). You are responsible for having the right to use any Inputs you provide.

4. AI-generated drafts — accuracy and review

Drafts are generated by an AI model and may contain errors, omissions, outdated information or content that is inaccurate or unsuitable. We do not warrant that any Output is accurate, complete, current, or fit for any purpose. The traceability and sourcing features are aids, not guarantees. You must independently review and verify every line and every cited source before relying on or lodging any report. Do not use isekio for any matter outside your professional competence or authorisation.

5. Register and third-party data

Register and mapping data is drawn from public sources and presented “as available”, under each source’s own licence terms. It may be incomplete, generalised, or out of date, and is not a substitute for your own searches and site verification. We are not responsible for the accuracy or availability of third-party data.

6. Acceptable use

Don’t: misuse the service; rely on Outputs without review; use isekio for unlawful purposes or beyond your professional authorisation; reverse engineer, scrape, resell or share access beyond your plan; upload malicious content; or infringe others’ rights. We may suspend accounts that breach these Terms.

7. Subscriptions, billing, cancellation and refunds

Paid plans are billed through Stripe in AUD. Prices are shown inclusive of, or with clear statement of, GST and any mandatory fees at the point of sign-up (no hidden or drip-fed charges). Subscriptions renew automatically each period until cancelled.

You can cancel at any time from your account settings, using no more steps than are reasonably necessary to end the subscription — we do not hide cancellation behind support tickets, phone calls or retention mazes. We give you clear notice of the key terms before you sign up, and reasonable notice before a renewal or before any free trial converts to a paid plan.

Fees already paid are non-refundable except where required by law (including the Australian Consumer Law). We may change prices on reasonable notice, effective from your next renewal.

These practices are aligned with the Competition and Consumer Amendment (Unfair Trading Practices) reforms — passed 1 July 2026, commencing 1 July 2027 — covering subscription disclosure, easy cancellation, drip pricing and unfair “dark pattern” conduct.

8. Availability

The service is provided on an “as is” and “as available” basis. During early access it may change, be interrupted, or have features added or removed. We don’t guarantee any particular uptime or that the service will be error-free.

9. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (ACL) or other law that cannot lawfully be excluded. Where our liability for a failure to comply with a consumer guarantee can be limited, it is limited (at our option) to re-supplying the service or paying the cost of re-supply.

10. Limitation of liability

Subject to clause 9, to the maximum extent permitted by law: we are not liable for any indirect, incidental, special or consequential loss, loss of profit, loss of data, or loss arising from your reliance on any Output or third-party data; and our total aggregate liability arising out of or in connection with the service is limited to the fees you paid us in the 12 months before the event giving rise to the liability. You acknowledge that the price of the service reflects this allocation of risk.

11. Indemnity

You indemnify us against claims, losses and costs arising from your use of the service, your Inputs and Outputs, your reliance on any Output, your reports, or your breach of these Terms — except to the extent caused by us.

12. Termination

You may stop using isekio and cancel at any time. We may suspend or terminate access for breach, non-payment, or where required by law. On termination you can, for a reasonable period, export your data; after that we may delete it (see the Privacy Policy).

13. Changes to these Terms

We may update these Terms; material changes will be notified (e.g. by email or in-app). Continuing to use isekio after changes take effect means you accept them.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
